Terms and Conditions
BY USING TCSN'S
INTERNET SERVICES, YOU AGREE TO BE BOUND BY THIS AGREEMENT, TCSN'S
SOFTWARE LICENSE AGREEMENT, ACCEPTABLE USE POLICY, AND SUCH OTHER USER
POLICIES AS TCSN MAY ESTABLISH FROM TIME TO TIME. IF YOU DO NOT AGREE
TO BE BOUND BY THIS AGREEMENT, YOU MAY NOT ACCESS OR USE THE SERVICE.
IF YOU CURRENTLY HAVE A TCSN ACCOUNT, YOU MUST CONTACT OUR OFFICES AS
SPECIFIED IN SECTIONS 10 AND 11 WITHIN 30 DAYS OF READING THIS
DOCUMENT.
TCSN provides the Service, defined below in Section 1, subject to your
compliance with this Agreement. Other services provided by TCSN will
not be subject to this Agreement unless this Agreement is expressly
incorporated into any other agreement regarding those services.
1. Service.
1.1 The Service includes: Internet access, Electronic mail ("email")
and if covered by the plan selected, website hosting on our servers.
1.2. Any means of identification assigned to you by TCSN (including
usernames and email addresses) will remain the property of TCSN and at
TCSN's sole discretion may be altered or replaced at any time.
1.3. TCSN makes no guarantees as to the continuous availability of the
Service or any specific feature of the Service. TCSN reserves the
right to change the Service or any of its features at any time with or
without notice.
2. Registration Requirements.
2.1. You must be at least 18 years old to register for the Service. By
accepting this Agreement, you represent that you meet this age
requirement. Minors who use the Service are assumed to have parental
or guardian consent to do so.
2.2. You agree to provide TCSN with accurate and complete billing
information including your legal name, address, and telephone number.
All changes to this information must be reported to TCSN within 30
days of the change.
2.3. By accepting this Agreement, you agree that you are responsible
for all charges posted to your account until you cancel the account as
specified in Section 11.
3. Fees.
3.1. Setup fees are nonrefundable, and TCSN does not issue refunds for
fees paid in advance. At the discretion of TCSN unused monthly fees
may be refunded if there is no usage on the account.
3.2. Unlimited dialup Internet access is offered by TCSN subject to
the following limitations:
3.2.1. Toll-free modem access is not provided by TCSN from a 1-800
number. Local calling areas are provided to the customer for use at
their own risk. (See section 3.2.3)
3.2.2. Use of TCSN's international access services will incur hourly
charges as specified by the long distance or local phone service
provider.
3.2.3. LOCAL ACCESS DIALUP NUMBERS MAY NOT BE AVAILABLE IN ALL AREAS.
IT IS YOUR SOLE RESPONSIBILITY TO DETERMINE IF USE OF A PARTICULAR
TCSN DIALUP NUMBER WILL CAUSE YOU TO INCUR LONG-DISTANCE, TOLL OR
OTHER CHARGES. TCSN IS NOT RESPONSIBLE FOR ANY LONG-DISTANCE OR TOLL
CHARGES INCURRED BY YOU THROUGH YOUR USE OF THE SERVICE. YOU ARE
SOLELY RESPONSIBLE FOR ALL TELECOMMUNICATIONS CHARGES INCLUDING LOCAL,
LONG-DISTANCE AND METERED TELEPHONE CHARGES FOR CONNECTION TO THE
SERVICE BY YOU AND BY THOSE WHO ACCESS THE SERVICE THROUGH YOUR
ACCOUNT.
3.3. Current prices for TCSN services are posted on TCSN's Rate Chart
at http://www.tcsn.net. These prices may also be obtained by calling
1-800-974-3475. TCSN reserves the right to change prices and institute
new fees. TCSN may change rates or institute new charges at any time
upon 30 days prior notice. TCSN does not issue pro rated fee refunds.
3.4. A service charge of $25.00 will be assessed to your account for
each check that is returned to TCSN for insufficient funds.
3.5. Payments for all accounts are due for the following months
services in which the charges are incurred on the first of that month.
If your account is delinquent, your account will be suspended or
canceled at TCSN's sole discretion. All billing notices are sent via
Email and no billings sent through the U.S Mail (unless specially
pre-arranged with TCSN for an additional cost). Internet dialup
accounts are due on the 1st of the month, become delinquent
on the 5th and will be suspended on the 10th of
the month.(exception: national accounts are due by the last day of
every month for the following month. No grace period on National
accounts) TCSN may, at its sole discretion, charge a fee of $5 to
reinstate a suspended account.
3.6. Interest charges of 1% per month (or the highest rate permitted
by law if lower than 1% per month) will accrue daily on any unpaid
balance that is more than 30 days old for any service.
3.7. TCSN cannot and will not be held responsible for any expenses or
charges resulting from charges billed by TCSN (example: exceeding
credit card limits, overdrawn accounts, etc).
3.8. You agree to pay all
sales and use taxes, duties, or levies that are required by law as
well as all attorney and collection fees arising from efforts to
collect any unpaid balance on your account.
3.9. If you believe that TCSN has billed you in error, you must
contact the Customer Service Department (per Section 11) within 60
days of the invoice or transaction date of the charge. Refunds or
adjustments will not be given for any charges that are more than 60
days old.
4. Use of the Service.
4.1. You and any members of your household are the only individuals
who are authorized to access the Service through your TCSN account.
You must not permit anyone else to access the Service through your
account and must ensure that all authorized users of your account
comply with this Agreement.
4.2 You are responsible for maintaining the confidentiality of
passwords used by you or members of your household.
4.3 You are responsible for all charges assessed as a result of use of
your account. However, TCSN will not hold you responsible for charges
attributable to an unauthorized user's access to your account without
your permission, provided that you notify TCSN within 24 hours of
discovering any such unauthorized use and the unauthorized use is not
attributable to the failure of any authorized user to exercise
reasonable efforts to maintain the confidentiality of the account or
password.
4.4 You are responsible for providing and maintaining all equipment
and other software necessary to access the Service including but not
limited to browser and Email software.
4.5. You will not use the Service or permit others to use the Service
through your account in any way that violates any law or regulation;
subjects TCSN to liability; or is in contravention of TCSN's
Acceptable Use Policy. You agree to comply with all TCSN security
procedures and standards and to be bound by the terms and conditions
of the End User License Agreement for any software provided to you.
5. Monitoring the Service; Disclosure of Member Information.
TCSN has no obligation to monitor the Service but may do so and may
disclose information regarding your use of the Service to satisfy
laws, regulations or governmental requests; to operate the Service
properly; and, to protect itself and its members. However, TCSN will
not disclose member information to outside persons or entities for the
purpose of soliciting TCSN members. TCSN, IN ITS SOLE DISCRETION, MAY
REMOVE OR REFUSE TO POST ANY INFORMATION OR MATERIALS, IN WHOLE OR IN
PART, WHICH ARE UNACCEPTABLE, UNDESIRABLE OR IN VIOLATION OF THIS
AGREEMENT.
6. No Warranties Provided by TCSN except that we will cover the
computers setup under our Internet warranty for a period of 60 days or
10 hours usage (whichever occurs first). This allows the customer to
bring their computer and have it setup by our technicians at our home
office located at 1306 Pine St. Paso Robles, CA. Warranty includes
software installation and setup but will not cover hardware
configuration, hardware installation or physical setup/delivery of
machine. Customer must have a valid call ticket number to claim
warranty under this provision.
6.1. Except for certain products and services specifically identified
as being offered by TCSN, TCSN does not control any information,
products or services on the Internet and except for such TCSN-identified
content, all merchandise, information and services offered, made
available, or accessible on the Internet are by third parties who are
not affiliated with TCSN.
6.2. YOU ASSUME FULL RESPONSIBILITY AND RISK FOR USE OF THE SERVICE
AND THE INTERNET BY YOU AND YOUR AUTHORIZED USERS. THE SERVICE IS
PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TCSN DOES NOT WARRANT
THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE OR THAT ANY
INFORMATION, SOFTWARE OR OTHER MATERIAL ACCESSIBLE VIA THE SERVICE IS
FREE OF VIRUSES, WORMS, TROJAN HORSES, OR OTHER HARMFUL COMPONENTS.
TCSN MAKES NO EXPRESS OR IMPLIED WARRANTIES, REPRESENTATIONS OR
ENDORSEMENTS INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE,
NON-INFRINGEMENT OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS
FOR A PARTICULAR PURPOSE REGARDING ANY MERCHANDISE, INFORMATION OR
SERVICE PROVIDED THROUGH TCSN OR ON THE INTERNET GENERALLY. NO ADVICE
OR INFORMATION GIVEN BY TCSN, ITS EMPLOYEES, AFFILIATES OR CONTRACTORS
SHALL CREATE A WARRANTY. 6.3 TCSN SHALL NOT BE LIABLE FOR ANY COSTS OR
DAMAGES ARISING DIRECTLY OR INDIRECTLY FROM USE OF THE SERVICE. IT IS
SOLELY YOUR RESPONSIBILITY TO EVALUATE THE ACCURACY, COMPLETENESS, AND
USEFULNESS OF ALL OPINIONS, ADVICE, SERVICES, AND OTHER INFORMATION,
AND THE QUALITY AND MERCHANTABILITY OF ALL MERCHANDISE PROVIDED
THROUGH THE SERVICE OR ON THE INTERNET GENERALLY.
6.4. THE INTERNET CONTAINS UNEDITED MATERIALS, SOME OF WHICH ARE
SEXUALLY EXPLICIT OR MAY BE OFFENSIVE TO YOU OR OTHERS ACCESSING THE
SERVICE THROUGH YOUR ACCOUNT. YOU ACCESS SUCH MATERIALS AND PERMIT
OTHERS TO ACCESS SUCH MATERIALS THROUGH YOUR ACCOUNT AT YOUR OWN RISK.
TCSN HAS NO CONTROL OVER AND ACCEPTS NO RESPONSIBILITY FOR SUCH
MATERIALS.
7. Your Remedies.
7.1. If you are dissatisfied with the Service or any of its terms,
conditions, rules, policies, guidelines, or practices, your sole and
exclusive remedy is to terminate this Agreement and discontinue using
the Service by canceling your account by one of the methods outlined
in Section 11.
7.2. UNDER NO CIRCUMSTANCES SHALL TCSN, ITS EMPLOYEES, AFFILIATES OR
CONTRACTORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL,
PUNITIVE, OR CONSEQUENTIAL DAMAGES THAT RESULT IN ANY WAY FROM ANY:
USE OF YOUR ACCOUNT OR THE SERVICE OR YOUR INABILITY TO USE THE
SERVICE; ACCESS OF THE INTERNET OR ANY PART THEREOF; OR, YOUR RELIANCE
ON OR USE OF INFORMATION, SERVICES OR MERCHANDISE PROVIDED ON OR
THROUGH THE SERVICE OR THAT RESULT FROM MISTAKES, OMISSIONS,
INTERRUPTIONS, DELETION OF FILES, ERRORS, DEFECTS, DELAYS IN OPERATION
OR TRANSMISSION, OR ANY FAILURE OF PERFORMANCE.
8. Indemnity. You agree to defend, indemnify, and hold TCSN and
its affiliates harmless from any and all liabilities, costs, and
expenses, including reasonable attorneys' fees, related to or arising
from: any violation of this Agreement by you or those who access the
Service through your account; AND, the use of the Service or the
Internet and the placement or transmission of any message,
information, software, or other materials on the Internet by you or by
those who have access to the Service through your account.
9. Term of Agreement. This Agreement is effective from your
acceptance thereof, which is indicated by your clicking the "I ACCEPT"
button at the end of this Agreement or upon the first use of the
Service through your account, whichever is first. If you are a current
TCSN member when this Agreement is activated, your continued use of
the Service constitutes your acceptance of this Agreement.
10. Termination of Agreement.
10.1. You may terminate this Agreement by using only the methods
outlined in Section 11. Your termination will only be complete upon
your receipt of a confirmation number from TCSN. REQUESTS FOR
ACCOUNT CANCELLATIONS VIA EMAIL WILL NOT BE ACCEPTED. TO CANCEL
YOUR SERVICE CALL 805-227-7000 EXT 200.
10.2. TCSN may terminate this Agreement at any time without cause upon
30 days prior notice; or, immediately upon notice if you, or any
person who has access to the Service through your account, commit a
material breach of this Agreement, including but not limited to a
breach of any obligation imposed under Section 4 or you fail to pay
any charges within 60 days of the date they accrue.
10.3. Upon termination of this Agreement all rights granted to you and
your authorized users under this Agreement shall immediately cease and
terminate; and, you must destroy or return to TCSN all copies of
software and documentation that you received from TCSN.
10.4. Termination of this Agreement does not release you from the
obligation to pay all accrued charges under this Agreement.
10.5.
TCSN's right to enforce the provisions of Sections 3, 5, 6, 7, 8, 11,
and 12 shall survive termination of this Agreement.
11. Notice.
11.1. This Agreement becomes effective upon registration of Subscriber's login identification name and shall remain in effect for the period indicated in the rate plan selected or until terminated as provided herein. This Agreement shall continue in effect for consecutive additional terms following the Initial Term until either Party gives the other party notice of termination at least thirty (30) calendar days prior to the expiration of the then-current term. In the event Subscriber terminates the Service hereunder, then without limitation to any other remedy ISP may have, Subscriber will pay to ISP upon discontinuance of the Service a termination charge equal to the applicable monthly rate times the number of months remaining in the term. You may change or cancel your TCSN account by the following methods only: Call TCSN Customer Service at 800-974-3475 or 805-227-7000 ext.200 or in person at our home office located at 1306 Pine Street, Paso Robles, CA.
REQUESTS FOR ACCOUNT CANCELLATIONS OR ACCOUNT CHANGES VIA EMAIL WILL NOT BE ACCEPTED. Please call 800-974-3475 or 805-227-7000 ext.200 for assistance.
11.2. TCSN may provide notice to you by the following methods: Electronic mail (email) addressed to your email account; general posting to TCSN's web site at http://www.tcsn.net/ ; or by US Mail or courier service at the address you provided TCSN when you registered for the service. All notices or other communications to you shall be deemed effective on the first (1st) calendar day following the date of electronic mailing or posting or on the fourth (4th) calendar day following the date of first-class mailing or deposit with a commercial courier service. Your cancellation will only be complete upon receipt of a cancellation number from TCSN.
12. Miscellaneous.
12.1. TCSN's failure to enforce strict performance of any provision of
this Agreement shall not be construed as a waiver.
12.2. This Agreement shall be governed by and construed in accordance
with the laws of the State of California, United States of America,
without regard to its conflicts of law provisions. You consent to the
personal jurisdiction of the federal and state courts having
jurisdiction for Paso Robles, California with respect to all disputes
arising out of this Agreement, your use of the Service or otherwise
between you and TCSN. Any cause of action you may have with respect to
the Service must be commenced within one (1) year after the claim or
cause of action arises or such claim or cause of action is barred.
12.3. Any action at law, suit in equity, or other judicial proceeding
concerning, relating to, arising from, or touching upon in any way, no
matter how remotely, the contract for services between you and TCSN,
Inc. and/or your use of and/or TCSN's provision of systems and
services hereunder, shall be brought and litigated, if at all, only
in the state court system of the State of California. In such event,
you acknowledge the right of the specified court to assert personal
jurisdiction in any such action over you and waive and release now and
forever any defense to that assertion of jurisdiction that might
otherwise exist.
12.4. Neither this Agreement, nor any of your rights or obligations
arising hereunder, shall be transferable by you to any third party
without TCSN's prior written consent. 12.5. This Agreement, the Rate
Chart, the Acceptable Use Policy, and the End-User License Agreement
constitute the entire agreement between you and TCSN with respect to
the Service.
12.6. TCSN reserves the right to alter, amend or modify this Agreement
at any time upon thirty (30) days notice. No amendment or modification
to this Agreement by you shall be valid or binding on TCSN unless made
in writing and signed by both parties.
12.7. Under California Civil Code Section 1789.3, California
subscribers are entitled to the following specific consumer rights
information: the Complaint Assistance Unit of the Division of Consumer
Services of the Department of Consumer Affairs may be contacted in
writing at 1020 N. Street, #501, Sacramento, CA 95814 or by telephone
at 1-916-445-1254.

Software used to connect your computer to the Internet is not the
property of TCSN and covered under the acceptable use policy of the
manufacturer and in no way covered under warranty by TCSN.

Acceptable Use Policy
These terms and
conditions govern your use of the TCSN.net Service. Please read them
carefully. By using the TCSN.net service, you agree to these terms. If
you do not agree to these Terms and Conditions, please contact
TCSN.net at (805) 227-7000 or via email at support@tcsn.net TCSN.net
reserves the right to modify these terms and conditions without prior
notice at any time. Please bookmark this page. We will attempt to
notify all our customers by email when our Terms and Conditions
change.
Enforcement
of Terms and Conditions
Our Terms and
Conditions are designed to provide maximum access to and enjoyment of
the Internet for our customers. As a TCSN.net customer you are
required to abide by these terms and conditions. Depending upon the
circumstances of any violation of our Terms and Conditions (including
any actions that cause damage, downtime, excessive load, or harm to
people or systems) we may issue a warning, suspend your service, or
terminate your account - without notice or refund. (And if
appropriate, we bill/collect our fee of $95 per-hour (plus any
expenses to collect) to repair malicious damage caused by
mail-bombing, spamming, hacking or attempting to damage our system, or
other networks via our system.)
Illegal activities
We are required
by law to report any criminal activity that we become aware of. Be
aware that if it comes to our attention that you are using our system
to commit illegal acts (e.g., storing or transporting commercial
software via our system illegally) we may immediately
suspend/terminate your service. We support your right to free speech,
but can't support your use of our service to harm, abuse, harass, or
libel others. By use of our service, you indemnify TCSN.net from any
damages resulting from your actions or the content you store on our
systems. However, if our attorneys believe TCSN.net will likely be
held liable for your content (e.g., libel/harassment) hosted on our
system, and you refuse to fix the problem, TCSN.net may terminate your
account.
Harassment and privacy
Your account and
business is private with us - we do not sell mailing lists and do not
share your private information. We ask you to do the same: Do not
snoop or disturb other users' files or directories. You may not harass
or threaten any of our staff or other customers. You may not make
public any private email, or provide any of our system files to other
persons on the Internet. You may not harass or make threats against
another person via email or news, web, or any other electronic
media/service we make available. Nor may you impersonate another
person. You must use your correct, reachable, TCSN-hosted email
address in all outgoing e-mail correspondence; we do not require this
for Usenet posting.
Spamming
Spamming is not
tolerated at TCSN.net. "Spamming" is sending unsolicited
email - whether "mass" or ostensibly targeted - to people
who have not asked for such email. Spam is also posting to Usenet
news a single cross-post to many users or many individual posts
to multiple individuals that are not related to the topic of your article,
or where doing so is in violation of a group's charter or common use.
Posting identical or nearly identical usenet posts on a regular (daily,
weekly) basis - with the exception of FAQ's and other informational
content posts - is similarly prohibited. Spam sent via other networks,
but referencing email addresses or websites at TCSN.net is similarly
prohibited. You may not provide an open mail relay as these are used
to send spam. You may not use TCSN.net as a "drop off' address
for replies to spam mail or spam posts sent from other networks. We
encourage the appropriate use of email and usenet news, and we do
not censor for content. All complaints from other Internet Service
Providers or their users in connection with violations of this section
will be replied to.
Denial of service attacks
You may not mount an attack against our system or any other. This
includes mail bombing, "hacking" or attempting to gain root access,
tsunami or flood bots or annoyance utilities like "nuke" or "land" or
"flash", employing packet sniffers, flood pings, etc.
Technical support
We at TCSN.net are
proud of our technical support staff. To maintain the high quality of
technical support our customers expect we must limit the availability
of telephone tech support to the primary account holder. We cannot
provide tech support for other persons whom you may authorize to use
your account. Similarly, we must limit tech support to issues related
to connectivity only. As a TCSN.net customer you are expected to be
familiar with your computer and capable of basic operations including
but not limited to editing or deleting files. We cannot teach you how
to design your web pages, how to write perl scripts, how to compile
code, etc. We can only offer such help on a consultancy basis, or we
may refer you to other specialists. However, we may (and frequently
do) - at our discretion and time permitting - assist customers with
non-connectivity issues. Providing such additional service shall not
be construed to mean that TCSN.net is obligated to provide such
service.
Payment and billing
All TCSN accounts
are due on the first of the month for that month's service. They are
delinquent on the 5th and service is disconnected on or about the 10th
for non-payment (except National Dialup Accounts that are due on the
last day of each month. National Accounts are suspended if not paid by
the last day of the month). The customer may be charged a $5.00
reconnect fee for accounts that have been suspended. The user is
responsible for the Monthly charges accrue from the time you sign up
until the time you formally cancel as specified in sections 10 and 11.
If you are not going to use your account for an extended period (14
days, minimum), you must notify TCSN.net in advance to avoid paying
for that interval. All TCSN.net prices are subject to change without
notice at any time, although barring special circumstances we will
give notice at least thirty days before any price increases. All TCSN
services are paid in advance, except (at our option) hourly consulting
services.
Extra charges and fees
TCSN.net
reserves the right to charge (and collect) for additional expenses
incurred. Listed below are rates for these services: (Add travel time
to all hourly rates where appropriate. All hourly rates 1/2 hour
minimum.)
Per-hour fee for
technician-level support (e.g., billing research, web consulting,
training, debugging scripts/code/configurations, etc.) - $95
Per-hour fee for
engineering-level support (e.g., router configuration, Telco problem
resolution, Sr. Sysadmin issues, research on collection issues,
harassment, banking, investment, marketing, design, or legal matters)
- $95
Late payment
fee/Credit card dispute fee (also applies if your account is closed
due to a repeatedly declined credit card) - $5
Returned check
fee - $25
Re-connection
fee (re-activate payment restricted account) - $5
In the event
your account is turned over to collections a fee of 15% of the balance
or $25.00, whatever is greater, will be added to the outstanding balance.
Domain Name
Billing Issues
See pricing
plan to determine charges for exact account. Contact TCSN.net about charges for moving, registering, or deleting a
domain name. We insist on
processing any and all DNS requests that reside on our servers. (Our
Business and Surfari commercial account customers get one free domain action
per account. TCSN.net does not charge fees on behalf of the domain
registration company – Internic charges (and domain ownership issues) are always the
responsibility of the customer. All domains hosted by TCSN.net or
using our DNS servers, are kept at TCSN.net until the customer has
paid all past debts to TCSN.net. We will not process any request to
move any domain for any customer having a past-due amount owed to
TCSN.net; and we reserve the right to wait for the check/payment to
clear the bank before releasing the domain. Similarly, we cannot move
domains to TCSN.net from other ISPs in cases where unpaid debts to the
former ISP are an issue.
Dialup usage
TCSN.net's
dialup accounts are flat rate for normal and reasonable usage. While
we allow family/business users to share one account, and currently
have no hard limits on connect time, we reserve the right to
disconnect sessions that we determine to be idle. We do not allow
users to access non-dedicated dialup accounts on an inactive or
standby basis, and reserve the right to bill the account at the
dedicated rate if such usage patterns persist after the user is
warned.
Concurrent dialups
Only one
simultaneous dial-in is allowed per account. This means that you may
not use more than one of TCSN.net's modems at the same time. If you
are found logged in more than once over a modem connection, we will
assume that your password has been compromised and may suspend your
account until you have been contacted. There are some circumstances
when we may permit multiple dial-ins on a prearranged basis. You may
purchase a Dual User Account that allows 2 people to be logged on at
the same time.
Local Numbers
Make sure that
the TCSN.net-supplied telephone number is local to you! TCSN.net
cannot, and will not be held responsible for phone charges, whether
due to our error, a Telco error, or yours. Always check with your
telephone company to insure a TCSN.net number is local to you.
TCSN.net will not reimburse for telephone company expenses under any
circumstance.
Disk allotments
Customers are
allocated web space according to the plan purchased. At our option we
may either restrict uploads above the assigned limit, or issue a
warning if your usage exceeds the assigned limit. We reserve the right
to remove any or all content in the event of gross overage (above
twice the assigned limit). Electronic mailboxes are allocated eight
megabytes of storage. Any mail that would cause a mailbox to exceed
this limit may be returned to sender or discarded, at our option. For

Bandwidth/CPU Usage
You may make
whatever material you like available on your web space as long as it
is legal and it does not generate traffic in excess of 60 megabytes
per day. For this reason, we strongly recommend that our customers
avoid storing any adult-oriented materials here. If your Internet site
suddenly consumes large amounts of bandwidth, we will contact you
regarding upgrading your account type to a high bandwidth rate.
Similarly, your actions/processes may not consume an unreasonable
amount of system resources.
Network availability
We reserve the right not to refund for temporary
service outages that are beyond our control, as well as for scheduled maintenance.
Our regular maintenance window for minor updates is each Friday between 5:00pm and 6:00pm.
Backup of data
TCSN.net
performs regular, scheduled backups of data stored on our servers. We
strongly recommend that you keep your own backups of your own data on
your own premises, especially if such data is of exceptional value to
you. Our backups are designed for recovery from serious system
failures - not for recovery of files accidentally or intentionally
deleted by users. We may be able to restore files a user has deleted
for a fee as long as more than 3-4 days has not elapsed.
